Aggravated DUI

Aggravated DUI is the only Felony Drunk Driving charge in Arizona. You can be convicted of a Class 4 Felony Aggravated DUI for:

  • Driving Under the Influence while your license is suspended or revoked F4
  • Driving Under the Influence 3 or more times within 84 months F4
  • Driving Under the Influence while you are under ignition interlock device (IID) restriction F4

or a Class 6 Felony Aggravated DUI for:

  • Driving Under the Influence while a person 15 years old or younger is inside the vehicle F6

Being convicted of Aggravated DUI in the State of Arizona, carries stiff penalties including:

  • Mandatory prison time, Revocation of your Driving Privileges for at LEAST one year
  • Revocation of your driving privileges for at least 1 year
  • Installation of an Ignition Interlock device for 24 months
  • An assessment fee of $250.00 and the potential of an additional $1,500.00 fee
  • A minimum fine of $750.00
